CRAFT CLASSIC WAIVER AND RELEASE: ALL PARTICIPANTS IN ANY RUNNING, JOGGING,
WALKING OR EXERCISE EVENTS OR OTHER GROUP ACTIVITIES, INCLUDING MULTIPLE,
REPETITIVE OR CONTINUOUS EVENTS AND ACTIVITIES AT ONE OR MORE LOCATION WHEREVER
LOCATED OVER AN EXTENDED PERIOD OF TIME, INCLUDING THE CRAFT CLASSIC (collectively
referred to as the “EVENT”) SPONSORED OR PROMOTED BY THE PARTIES NAMED BELOW
ARE REQUIRED TO, AND HEREBY DO, ASSUME ALL RISK OF PARTICIPATION IN THE EVENT
BY SIGNING THIS WAIVER AND RELEASE AGREEMENT: The undersigned
participant ("Participant") on behalf of himself/herself and on
behalf of Participant's personal representatives, assigns, heirs, executors,
and successors, hereby fully and forever releases, waives, discharges and
covenants not to sue ROAD RUNNER SPORTS RETAIL, INC. and ROAD RUNNER SPORTS,
INC., and their affiliated companies and charities, the sponsors of the Craft
Classic, High Performance Movement, RacePlace Event Systems, Inc., Team RWB,
City of San Diego, San Diego County, USAT&F, Green Flash Brewing
Co., coordinating groups, and any individuals associated with the
event, any and all municipal agencies whose property and/or personnel are used
or in any way assist the Event, all sponsoring or co-sponsoring companies or
individuals related to the Event, together with all officers, directors, shareholders,
employees, successors and assigns of the parties named above, (collectively "Releasees")
from all liability to the Participant and his/her personal representatives,
assigns, heirs, executors, and successors, for any and all loss(es), damage(s) and
any and all claims or demands therefore, on account of injury to Participant,
or resultant death, or to his/her property, whether caused by all or any of the
Releasees or otherwise, in connection with Participant's participation in any
Event at any time in any location. Participant represents and warrants
that he/she is in good physical condition and is able to safely participate in
the Event. Participant is fully aware of the risks and hazards inherent
in participating in the Event and hereby elects to voluntarily participate,
knowing the risks associated with the Event. Participant hereby assumes all
risks of loss(es), damage(s), and injury(ies) that may be sustained by him/her
while participating in the Event. It is understood and agreed that Participant hereby
assumes liability for any and all medical expenses incurred as a result of
training for and/or participation in the Event, including but not limited to
ambulance transport, hospital stays, physician fees, and pharmaceutical goods
and other medical services. Participant warrants that all statements made
herein are true and correct and understands that Releasees have relied on them
in allowing Participant to participate in the Event. PARTICIPANT HAS READ THE
FOREGOING AND INTENTIONALLY AND VOLUNTARILY SIGNS THIS WAIVER AND RELEASE
AGREEMENT. RIGHT TO USE PHOTOGRAPHS AND RECORDINGS. I, being of
legal age, hereby grant permission to Road Runner Sports Retail, Inc. and Road
Runner Sports, Inc., its subsidiaries, assigns or successors (“Road Runner
Sports”), to use photographs, artwork, audio or video of me in whatever
way they desire, including television, CD-ROMs, Internet, retail or catalog
display, and any other form for the storage, retrieval, display and reproduction
of information or images; furthermore, I hereby consent that such information,
photographs, videos, or other reproductions, and the plates and/or tapes from
which they are made, shall be Road Runner Sports’ property, and that Road
Runner Sports, Inc. shall have the right to sell, duplicate, reproduce and make
other uses of such information, photographs, videos, recordings, and plates as
they may desire, free and clear of any claims, actions or liability on my part
whatsoever. In filling out this form, I acknowledge I have read and
fully understand that this is a legally binding contract that waives and
releases my legal rights. This entry is invalid unless signed by participant.
If entrant is under 18 years of age, parent or legal guardian must sign below. I
understand that all entries are final with no refunds.
