 I represent and warrant that I have full legal authority and capacity to effectively waive the important legal rights I, or the person identified above enjoy relating to participation in the above-identified event (hereinafter “event”) occurring on May 18, 2019. If I have signed this document, but it relates to a participant in the event other than me (hereinafter “other registrant”), then I represent that I am signing this document as the parent or legal guardian of the person whose name appears above.   I know that running, walking or otherwise participating in all “road” and “foot” races is a potentially hazardous activity. By signing below I represent that I or the other registrant identified above is medically able and properly trained to participate in the event. I agree, and I represent that I have instructed the other registrant to abide by the directions of an event official that relates to the safe participation in the event. I assume all risks and responsibilities associated with my participation or the participation of the other registrant in this event, including, but not limited to:  falls, contact with other participants, the effects of weather, including high heat and humidity, vehicular and pedestrian traffic, and the conditions of all areas, surfaces and terrain that serve as the course for the event; all such risks being known and understood by me. I understand that bicycles, skate boards, roller skates and roller blades, animals, and radio headsets are not allowed anywhere along the course of the event, during the event, and I agree to comply with this rule of the event.   In connection with my participation or the participation of the other registrant in the event, I do hereby agree to release, defend, indemnify and hold harmless the Lakeland Police Foundation, Inc.,  FITnice Events, Inc., FITniche Inc., and both entities' officers, directors, contractors, sponsors and agents from and against all claims, damages, losses, and expenses, including, but not limited to, reasonable attorney’s fees and incidental defense costs arising out of, or resulting from all acts and failures to act which may occur in relation to the event. I acknowledge and agree that by signing this document I am legally binding my spouse, heirs, legal representatives, next of kin, executors, and administrators to the content and substance hereof.  I further acknowledge that this indemnification obligation shall not be subject to any limitation as to the amount or type of recovery sought, or, on the amount or type of insurance coverage secured by me and/or on behalf of the other registrant, the Lakeland Police Foundation, Inc., FITniche Events, Inc., FITniche Inc., or the sponsors, contractors or agents of the Lakeland Police Foundation, Inc.
