MOUNTAIN MUD’R CONSENT, WAIVER & RELEASE   I hereby waive, release, and discharge the Town of Tazewell, the event director and the Mountain Mud’R race affiliated support (Race Director), the sponsors, the support personnel (Town of Tazewell EMS, town of Tazewell Fire Department, etc.), and each of their respective agents and employees, from any and all claims of death, personal injury (either physical or mental), or property damage which I may have, incur, or which may hereafter accrue to me, as a result of my participating in the Mountain Mud’R.  I further state that I am physically fit to participate in the Mountain Mud’R, acknowledge and assume all of the risks associated with my entry into this race, and further acknowledge that I may be subject to injury, including but not limited to fractures, lacerations and possibly death.  I understand and further agree that photographers and video production may take place on the course during this event, and I hereby consent to being photographed and acknowledge that my likeness may be used for event promotion at any time in the future without compensation.  This release is intended to discharge and hold harmless, in advance, the Town of Tazewell, event promoter, the race direct and race affiliated support, the sponsors, the support personnel, and each of their respective agents and employees, from and against any and all liability arising out of or in any way connected with my participating in said event, even though liability may arise out of or from the negligence or carelessness on the part of the person or entities mentions above.  It is further understood and agreed that this Waiver & Release is signed freely and voluntarily, and is to be binding on my heirs and assigns.
